    Abstract:

The legal constituents of “patients’ valid consent” in medical behaviors include doctors’ sufficient inform, having the capacity of consent, patients’ independent and voluntary consent. Nowadays, after the medical behaviors, patients often claim damages based on their invalid consents. Thereby, during the medical behaviors, doctors should respect patients’ self-鄄determination rights and enhance the communication with patients. On the other hand, doctors should adhere to the regulations and rules to protect themselves.
