    Abstract:

The quality of medicines has close relations with the patients’ rights of life and health, and closely connects with basic human rights. Drug Administration Law of the PRC,which is revised in the 20th meeting of the Ninth National People’s Congress Standing Committee,on February 28,2001,abolished the provision that the limitation of action period of medicine-induced physical damages was one year. The change extended the period of maintaining legal rights, strengthened the public power’s protection of legal remedies towards victims, and fully reflected the basic purposes and spirit of legislation to protect the basic human rights and preserve people’s health and legitimate rights and interests of medication.
