    Abstract:

    Under Tort Law section 60,medical institutions is not responsible for three special statutory exemptions,including patient’s fault,emergency medical treatment and the limit of medical standards;As a tort liability,medical damage liability applies to common exemptions of “Tort Liability Law” Chapter Ⅲ,including intentional fault of patient,the fault of third party and force majeure;However,the prior exceptions signed by medical institutions is invalid.
