    摘要:

    近年来,脑机接口技术呈现迅猛发展态势,各类脑机接口生成物不断涌现。然而,对这些生成物的著作权保护却陷入现实困境,具体表现为:生成物是否符合作品构成要件存疑,权益归属界定不明,侵权判定标准难以确立。为维护创作者合法利益,并促进技术创新与发展,将脑机接口生成物纳入著作权保护体系势在必行。因此,需明确其可版权性,界定著作权归属,加强脑隐私数据保护,以此解决著作权保护的现实困境,推动脑机接口技术持续进步。

    Abstract:

    In recent years,brain-computer interface technology has shown rapid development,with various brain-computer interface-generated products continuously emerging. However,the copyright protection of these products faces practical challenges,specifically manifested as uncertainty about whether the products meet the standard as constituent elements of the work,unclear attribution of rights and interests,and difficulties in determining the standard for infringement. To safeguard the legitimate interests of creators and promote technological innovation and development,it is imperative to incorporate brain-computer interface products into the copyright protection system. Therefore,it is necessary to clarify its copyright eligibility,determine the ownership of authorship copyright,and strengthen the protection of privacy data related to the brain. These aim to alleviate the practical challenges of copyright protection and promote the steady advancement of brain - computer interface technology.
