Abstract:Although Tort Liability Law of China Provides for the obligation of the physician to protect patients’ secret information, the nature of the right is confusing and the right limit is not clear. The right of protecting patients’ secret information should be identified as privacy or personal information to self-determination according to the nature and manner of use of the information. Physicians should bear the obligation of confidentiality, but in the presence of the public interest, the interests of other people's lives and health and implied consent of patients, some patients should allow physicians to provide their secret information to specific institutions or individuals.
