Abstract:In the medical and health services, hospice care has been paid more and more attention. There is a lack of legal regulations on hospice care in our country, which hinder the practical implementation. The legitimacy of legislation lies in the dignity of human beings. The rights to life and medical autonomy are important sources of hospice care. The relevant contents of the Constitution, Civil Code, Law on the Promotion of Basic Medical and Health Care are the main legal basis of hospice care. On the one hand, the application of advance medical directives under informed consent rules may lead to conflicts of rights, so the rules need to be improved to strengthen the practical applicability. On the other hand, the coordination of multiple subjects of hospice care is helpful to solve the legislative problems of hospice care. The regulatory framework of hospice care should include a standardized system of advance directives, a strict review system and supervisory mechanism.
