    摘要:

    近年来,脑机接口技术呈现出迅猛发展态势,由此衍生的各类脑机接口生成物不断涌现。然而,对这些生成物的著作权保护却陷入现实困境,具体表现为:生成物是否符合作品构成要件存疑,权益归属界定不明,侵权判定标准难以确立。为保障残疾人权益、维护创作者合法利益,并促进技术创新与发展,将脑机接口生成物纳入著作权保护体系势在必行。因此,需明确其可版权性,界定著作权归属,加强脑隐私数据保护,以此纾解著作权保护的现实困境,推动脑机接口技术持续进步。

    Abstract:

    At present, brain-computer interface technology is developing rapidly, and brain-computer interface products are constantly emerging. However, the copyright protection of brain-computer interface products is facing practical difficulties, mainly reflected in the doubt of whether the products constitute works, the ambiguity of the rights and interests of the products, and the challenges in determining the infringement of the products. To protect the rights and interests of people with disabilities, safeguard the legitimate rights and interests of authors, and encourage innovation and technological development, it is necessary to include the products of brain-computer interfaces in copyright protection. Based on this, it is necessary to clarify the copyright of the products of brain-computer interfaces, define the copyright ownership of the products of brain-computer interfaces, and strengthen the protection of brain privacy data, so as to alleviate the practical predicament of copyright protection of the products of brain-computer interfaces and promote the development of brain-computer interface technology.
