Abstract:Amendment Ⅵ to the Criminal Code of the People’s Republic of China established a crime called cheating on loans. It helped to offer a legislative basis for cracking down on abusing loans. The crime prescribed the purpose of loans and means of loans rather than the purpose of loans only. The change definitely affected our judicial practice. The key to use this legislative mode was understanding three different crimes (cheating on loans, transfer loans in high interest, swindling loans ) and their relationships.
