Nowadays，medical interns play an important role in curative activities，but whose legal status is really awkward. Relevant laws are very ambiguous about medical interns’ legal status，which are even in a blank condition basically. As a result，we should begin to explore the dilemma of medical interns’ curative activity，analyse the lack of legislation to medical interns，define medical interns’ curative activity from practical case and theory of law，and put forward the concept of preparatory doctor. At last，we study how to confirm the legal status of preparatory doctor for medical interns expressly by legislative way，quoting administrative penalty methods，setting up medical interns-fund and so on.
