Legal balance between public interest and private benefit in the

prevention and control of epidemic

Abstract：In the process of COVID⁃19 prevention and control，more restrictions are imposed on citizens’
freedom in the administrative law enforcement for the purpose of public health protection. In order to fully
respect citizens’personal freedom，the needs of information and remedy，on the one hand，we can refine the
public participation system，improve the emergency response system，and clarify the legal concepts so as to
improve the legal provisions；On the other hand，the government can adopt the flexible law enforcement，

strengthen the principle of proportionality， and establish a cross ⁃ regional coordination and cooperation
mechanism to ensure the reasonable exercise of administrative power.
